The following General Conditions govern the offer and sale on the website https://scorpionshop.it (hereinafter "Site") and are drafted in accordance with the legislative provisions of the Civil Code, Legislative Decree No. 70/2003 on information society services and electronic commerce, and Legislative Decree 206/2005 (hereinafter "Consumer Code").

The products marketed on the Site are sold directly by Bettarello Fabio (hereinafter, the "Seller"), Via G. Servais 200/a/14, Torino 10146 (TO). VAT: 12461780012

1. Scope of application
These General Conditions apply and govern all sales contracts concluded through the Seller's Website, as identified above.

The purchase of products on the Site is reserved exclusively for individuals (hereinafter "Users") who act as consumers and who have reached the age of 18.

"Consumer" means any natural person who acts for purposes outside their commercial, business, craft, or professional activity.

The General Conditions may change over time and Users should read them carefully before making any purchase. It is the User's responsibility to check the General Conditions before submitting any order.

The Seller is never responsible for the sale of products by third-party resellers through links, banners, or hyperlinks present on the Site. Before confirming orders to third parties, the User must verify their own sales conditions.

Bettarello Fabio, as an online seller, is not required to issue any invoice (nor receipt, nor any tax document) in favor of a consumer (who is not subject to VAT), pursuant to art. 22 of the Decree of the President of the Republic of 26/10/1972 no. 633 and article 2, letter o) of DPR December 21, 1996, no. 696 (as confirmed by resolution no. 274 / E of November 5, 2009).

The request for the issuance of the invoice is possible no later than the moment the order is placed pursuant to art. 22 DPR 633/1972.

2. Conclusion of the contract
These General Conditions are an integral and essential part of the sales contract between the Seller and the User. The electronic submission of the order by the User implies full knowledge and full acceptance of these General Conditions, the Terms of Service, and the Privacy Policy.

To place an order for the online purchase of one or more products, the User must provide the Seller with all the necessary data for the fulfillment of the order.

To conclude a purchase contract, the User must submit their order through an electronic order form available on the Site. The submission of the order generates the obligation for the User to pay the final price indicated therein.

To complete the purchase, the User is required to confirm the payment of the price of the products in the cart. Orders that do not correspond to a completed transaction will not be processed.

At the time of placing an order, the User will receive a confirmation email of the order receipt and a summary of the order.

If the products displayed on the Website are no longer available at the time of the User's last access or at the time of order submission, where possible, they will be reordered or produced again with timing based on the product.

The order form includes a link to the General Conditions and the Privacy Policy, as well as a summary of the essential characteristics of each ordered product; the corresponding price; accepted payment methods; delivery options; and related shipping costs.

At any time, the User can monitor the status of their order and access the history of their past orders through their account on the Seller's Site or by contacting Customer Service via email at scorpionshopit@gmail.com.

3. Products for sale on the website

The product catalog may be updated and modified periodically, therefore the permanence of a product among those available online is not guaranteed.

The essential characteristics of each product are reported in a dedicated product sheet; the images and colors of the products displayed on the Site do not exactly correspond to their real colors, as this is influenced by the settings of the devices used by the User to access the Site. Therefore, the images of the products are to be considered indicative, and the usual levels of tolerance remain.

Visible products are divided into 'Collections' that describe the manufacturer and/or origin. Some of the Collections are interconnected due to the collaboration between different companies that leave the Seller the procedures and methods of purchase and shipping.

Products where availability is indicated means that they are available for ordering. They may therefore be either in stock or to be produced or awaiting restocking. Details on timing are generally explained in the product description and/or the associated collection.

Items in the 'out of stock' state are currently not orderable due to lack of production or unknown arrival times.

4. Sale Prices
The prices of products for sale on the Site include VAT and any other tax applicable to the sale of products to Users purchasing within the European Union.

In the case of Users placing an order from a country outside the European Union, the price is indicated as net. VAT and any additional taxes that may apply in the destination country are not shown. If applicable, these taxes will be collected at the time of delivery of the product. The product may be subject to import duties which, if applicable, will also be collected at the time of delivery of the product.

The shipping address provided by the User in the order form determines the geographical origin of the order.

Product prices may be subject to updates and changes. The User is required to verify the final price before submitting the related order. In case of a manifest material error on the price displayed on the Site - compared to the commonly known price of the chosen product - the Seller, at their sole discretion, may not confirm the shipment and proceed with an immediate refund of the amount paid by the User.

Shipping costs and types may vary depending on the Country and the type of shipping chosen by the User.

Such costs and any additional costs will be borne by the User. The relevant amount will be explicitly specified in a dedicated line of the order summary, before the User proceeds to submit the order. These expenses will also be indicated as in the order confirmation email.

5. Payment method
The User will choose one of the methods indicated in the order form.

The order amount will be charged immediately after payment.

The User is solely responsible for the correctness and accuracy of the data entered and guarantees to use only payment methods (credit/debit cards, payment service accounts) for which they have legitimate availability.

6. Delivery method
The products are delivered directly to the User - or to a person explicitly indicated by them - at the shipping address specified in the order, via contracted couriers.

The Seller will do everything possible to fulfill the order within 2 working days and, in any case, no later than a week from the day after the User has submitted the order. The shipping cost varies based on the weight of the product (see the 'Shipping' section with estimated delivery times around 48-72 hours, except for reservations and orders).

No liability, of any kind, can be charged by the User to the Seller in case of delay in fulfilling the order and/or in delivering the products subject to the purchase contract. The ordered products will be delivered to the postal address specified by the User. Deliveries will be made from Monday to Friday, excluding national holidays. Delivery is considered completed at the moment the product is made available to the User at the address specified in the order form. In case of non-delivery due to the absence of the recipient at the specified address, the courier will reschedule the delivery for the following day. If delivery cannot be made the following day due to the absence of the recipient, customer service will attempt to contact the User to schedule a new delivery. In the event that customer service is unable to contact the User for the next 10 days or in case of further inability to deliver due to the absence of the recipient, the products subject to the order will be returned to the Seller.

The Site allows requesting the delivery of ordered products to an address different from that of the User, provided it is included in the User's country of residence indicated in the billing address box; in any case, it is the User's responsibility to provide all necessary details for the successful outcome of the delivery.

The User will be notified of the fulfillment of their order via a specific message sent to the email address indicated in the order form.

At the time of delivery of the products by the courier appointed by the Seller, the User is required to carefully check:

- that the label, if present, is intact and the packaging is not damaged and/or altered in any way
- that the total number of pieces delivered corresponds to the number indicated in the transport document

Any damage to labels, packaging, products, or the lack of correspondence of the number of pieces and/or packages must be immediately contested by the customer, who can contact the Seller through customer service specifying the order for which such issues occurred. Cases of force majeure, unavailability of transport means, as well as unpredictable or unavoidable events that cause delays in deliveries or make deliveries difficult or impossible or cause a significant increase in delivery costs borne by the Seller, will entitle the Seller to split, postpone, or cancel, in whole or in
part, the expected delivery or to resolve the purchase contract. In such cases, it will be the Seller's responsibility to provide timely and adequate communication of its determinations to the email address indicated by the User, and the latter will be entitled to a refund of the price possibly already paid, excluding any further claims, of any kind, against the Seller.

7. Preorders
In cases where the purchase of products not yet made ("preorders") is proposed, the User will be informed of this circumstance by a specific indication in the online catalog.

The delivery terms referred to in point 7 start from the moment the Seller takes possession of the products themselves.

8. User obligations
Minors cannot place orders on the website.

The data entered during the purchase procedure will be your actual personal data and not that of third parties or fictitious data. The Seller reserves the right to take legal action against any violation and abuse, in the interest and for the protection of all consumers.

The User relieves the Seller of any liability arising from the issuance of incorrect tax documents due to errors related to the data provided by the User, being the User solely responsible for the correct entry of the data.

The User is required to verify the contact and shipping details before completing the purchase through the appropriate summary panel shown at the end of the ordering process. The Seller disclaims any responsibility arising from errors in the entry of data not attributable to its fault, including any loss of the purchased product.

Upon receipt of the products, the User must verify the conformity of the goods with respect to the order. In particular, the User must pay attention to the correspondence between the number of packages indicated on the waybill and those delivered, and to the integrity of the packaging.

Any anomalies (e.g. tampering, damage) must be specified in writing directly on the courier's transport document, and the User must refuse the delivery.

At the same time, the User is required to report such facts to the Seller's Customer Service via email at the address scorpionshopit@gmail.com

The User's acceptance of the delivery of tampered and/or damaged products will invalidate the legal warranty of conformity.

9. Liability
The Seller will not be liable for any service interruptions due to force majeure causes such as, for example, accidents, explosions, fires, strikes, earthquakes, and other events that prevent, in whole or in part, the execution of the contract within the agreed terms.

The Seller will not be liable to any party or third parties for damages, losses, and costs incurred as a result of the non-performance of the contract for the reasons mentioned above. The customer will only be entitled to a refund of the price paid.

In the same way, the Seller is not responsible for any fraudulent and illegal use that third parties may make of credit cards and other means of payment when processing the payment for the products. The Seller cannot know, at any time during the payment procedure, the credit card number of the User, which, by opening a secure connection, is transmitted directly to the payment service provider.
